How long do I have to file a claim?
The time limit for filing a claim varies depending on the nature of the claim.
For workplace injuries, a claim must be filed with the Department of Labor & Industries (L&I) within one year of the date of the injury; however, the sooner the better.
In cases involving occupational diseases, the claimant has two years from the date a health care provider tells him or her about the disease and its possible relationship to work.
What types of injuries are covered?
Scope of Coverage Workers' compensation in Washington covers:
A. Traumatic injuries (e.g., broken bones from falls)
B. Occupational diseases (e.g., repetitive motion injuries)
C. Work-related diseases (e.g., respiratory conditions from chemical exposure)
D. Minor cuts and bruises, sprains.
Exclusions:
A. Unauthorized activities (e.g., sports injuries, home injuries, leisure activities)
B. Substance abuse
C. Pre-existing conditions not aggravated by work
What should I do if my claim is rejected?
Well, there are two things you can do.
First, you can file a formal protest. This means writing a letter, either by yourself or with your doctor, explaining why you disagree with the denial.
Make sure to include any objective findings that might help your case. If that doesn't work, you can file an appeal with the Department of Labor and Industries within 60 days of getting the denial notice.
It might be a good idea to contact a lawyer who specializes in workers' compensation to help you through this process
What happens if my employer retaliates against me for filing a complaint?
Under Washington state law, employers are prohibited from retaliating against employees for filing a workers' compensation claim.
If you suffer retaliation, such as being fired or demoted, you may be entitled to reinstatement, back pay, and other damages.
You can file a complaint with L&I or consult with a workers' compensation attorney to understand your rights and pursue further action.
